Mombasa Air Flight Terms and Conditions

1. Liability & Governing Law

  • MAS’s liability is governed by the Warsaw Convention and Kenyan law. Claims and disputes are determined exclusively by Kenyan courts.

2. Non-Smoking Flights

  • All flights are strictly non-smoking.

3. Ticket Use & Transferability

  • Tickets are valid only for the named passenger and cannot be transferred. Name changes are not permitted.

4. Children & Accompaniment

  • Children under 12 must be accompanied by an adult.

5. Documentation

  • Passengers are responsible for ensuring they have all necessary travel documents (passports, visas). MAS accepts no liability for costs if boarding is denied due to missing or incorrect documents.

6. Check-in & Boarding

  • Domestic: Check-in closes 30 minutes before departure.
  • International: Check-in closes 1 hour before departure.
  • MAS may depart up to 10 minutes early if passengers are absent.
  • If not checked in 15 minutes prior, seats may be allocated to standby passengers.

7. Refunds, Cancellations & Amendments

  • Tickets are non-refundable and non-transferable.
  • Cancellation more than 14 days before travel: Refund minus $30 admin fee.
  • Cancellation within 14 days: No refund unless for verified exceptional circumstances, in which case $30 admin fee applies.
  • Amendments more than 96 hours prior: No charge. Within 96 hours: $50 per passenger, subject to availability.

8. Missed Connections & Delays

  • MAS guarantees connections only between its own flights, not for other carriers.
  • In case of significant delays, MAS provides refreshments/meals. Overnight accommodation is provided if flights cannot operate due to exceptional reasons, but MAS is not liable for indirect costs.

9. Baggage Policy

  • Standard allowance is 15 kg per person (including hand baggage).
  • Excess baggage carried only at captain’s discretion and at prevailing rates.
  • MAS is not liable for valuables in checked baggage. Compensation for lost/damaged baggage is limited to $10 per kg.
  • Animals are considered freight, require prior notice, and must be in approved containers.

10. Flight Schedule & Operations

  • Timetables are not contractual and may change for operational, weather, or safety reasons. MAS may require a minimum number of passengers to operate a flight.

11. Conduct & Right to Refuse Carriage

  • MAS may deny boarding or offload passengers who:
    • Pose safety or security risks.
    • Are under the influence, disruptive, abusive, or refuse security/safety checks.

12. Website & Online Services

  • Booking and use of www.mombasaairsafari.com constitutes acceptance of terms.
  • Online orders are only final upon payment confirmation. Payment is by credit card only.
  • MAS is not liable for errors in booking details provided by the user.
  • Cancellation of online orders may be subject to full cancellation fees; confirm with MAS before cancelling.

  • Personal details are only shared with trusted partners to fulfill service. MAS strives for information security but cannot fully guarantee against unauthorized access.
